The Egyptian Official Gazette (Al-Waqa’i Al-Misriya) published the Ministry of Housing, Utilities, and Urban Communities Decree No. 723 of 2026 concerning the removal of the property located at 31 Refaa El-Tahtawy Street, Dokki, from the Giza Governorate Architectural Heritage Register.
The decision implements the court ruling issued in Case No. 27640 of Judicial Year 67 during the session held on November 27, 2019, with the property recorded in the register under Serial No. 125 as 31 Refaa Street – Dokki District, while observing the conditions stipulated in the State Lawsuits Authority’s Letter No. (3) dated February 8, 2026.
Details of the Decision
Ministry of Housing, Utilities, and Urban Communities Decree No. 723 of 2026 states:
The Minister of Housing, Utilities, and Urban Communities, after reviewing the Constitution; Law No. 144 of 2006 regulating the demolition of buildings and structures that are not at risk of collapse and the preservation of architectural heritage, along with its executive regulations and amendments; Presidential Decrees No. 258 of 2024 and No. 75 of 2026, concerning the formation of the Cabinet;
Prime Minister’s Decree No. 2276 of 2006 establishing the standards and specifications for buildings and structures of distinguished architectural character; Prime Minister’s Decree No. 2273 of 2010 listing certain properties in the Giza Governorate Architectural Heritage Register;
Prime Minister’s Decree No. 243 of 2019 delegating to the minister the powers stipulated in the aforementioned law regarding the listing, addition, and removal of properties pursuant to Article Two of the law; and Ministerial Decree No. 1204 of 2024 forming a working group within the Ministry to undertake the necessary procedures concerning buildings and structures proposed for listing, addition, or removal from the register of architecturally distinguished buildings and structures in the governorates in accordance with the provisions of the aforementioned law and its amendments.
Also after reviewing the application submitted by the legal representative of some, but not all, of the successful litigants, registered under No. 174 of 2026 and its attached documents; the copy of the ruling issued by the Administrative Court (Fourth Circuit) in Case No. 27640 of Judicial Year 67 during the session held on November 27, 2019, bearing the executive enforcement formula, which accepted the case in form and ruled to annul the challenged decision together with all resulting legal effects;
And the letter of the deputy president of the State Council and legal adviser to the minister, No. 57 of 2026, confirming that there is no legal objection to preparing a draft decision removing the property covered by the aforementioned judgment in accordance with its operative provisions and reasoning, following receipt of the State Lawsuits Authority’s approval to implement the ruling.
The decree further considered the letter of the secretary-general of Giza Governorate No. 2993 of 2026 and its attachments, including the State Lawsuits Authority’s letter No. (3) dated February 8, 2026, confirming no objection to implementing the court ruling in accordance with its operative provisions while observing the conditions contained in the same letter; and the memorandum submitted by the first undersecretary of the ministry, head of the Housing and Utilities Sector, and chairman of the working group.
Article One
The property located at 31 Refaa El-Tahtawy Street, Dokki, shall be removed from the Giza Governorate Architectural Heritage Register in implementation of the court ruling issued in Case No. 27640 of Judicial Year 67 during the session held on November 27, 2019, recorded in the register under Serial No. 125 as 31 Refaa Street – Dokki District, while observing the conditions stipulated in the State Lawsuits Authority’s Letter No. (3) dated February 8, 2026.

This decision shall be published in the Egyptian Official Gazette (Al-Waqa’i Al-Misriya).
