In new developments concerning the Old Rent Law, the Supreme Constitutional Court on Tuesday admitted a new appeal challenging the constitutionality of the recently amended legislation on rental agreements.
Previously, the President had ratified Law No. 164 of 2025 regarding certain provisions related to rental laws, aimed at reorganizing the relationship between landlords and tenants.
This appeal is considered the first to be filed against the newly approved Old Rent Law, which has sparked heated disputes between landlords and tenants operating under the old rental system.
Urgent Lawsuit to Suspend Implementation of the New Rent Law
A dispute execution case, No. 32 of Judicial Year 47 Constitutional, was registered on August 28. The lawsuit demanded the urgent suspension of Law No. 164 of 2025, particularly Article Two, which stipulates that lease contracts for residential properties subject to this law shall end after seven years from its enforcement date—unless an earlier termination is agreed upon—until the court rules on the dispute.
Demands to Abolish Article Two of the New Law
The lawsuit also requested the continuation of two previous rulings issued by the Supreme Constitutional Court in November 2002: Case No. 70 of Judicial Year 18 Constitutional and Case No. 105 of Judicial Year 19 Constitutional. Additionally, it demanded the annulment of Article Two of Law No. 164 of 2025, its exclusion from implementation, the undertaking of related legal procedures, and the imposition of case expenses on the concerned parties.
