Cabinet Approves Granting Old Rent Landlords Access to Residential Units

The Cabinet, chaired by Prime Minister Dr. Mostafa Madbouly, has approved a draft decision concerning the rules and procedures for implementing Article (8) of Law No. 164 of 2025, which regulates the relationship between landlords and tenants. The draft aims to enforce Article (8), ensuring tenant rights in line with previous legislation.

The draft decision stipulates that the Social Housing and Mortgage Finance Support Fund will coordinate with government authorities to determine the number of available units in each governorate along with their basic details, to be presented to the Cabinet for approval. It also establishes a central administration within the Fund, under the title “Rent and Alternative Housing,” tasked with reviewing tenant applications for access to residential or non-residential units.

The articles define the eligibility conditions for allocation: the applicant must be a natural person, a tenant of a residential or non-residential unit, or someone to whom the lease has been legally extended. The applicant must also be residing in the rented unit, must not have left the unit closed for more than a year without valid justification, and must not own another unit suitable for the same purpose.

The draft decision allows applicants to submit allocation requests and required documents in paper form through post offices across all governorates. This measure aims to ease the application process for groups who may face difficulties using online platforms, such as the elderly, people with limited education, individuals with disabilities, or anyone struggling with digital tools.

The draft also organizes the mechanism for reviewing allocation requests, sets timeframes for the process, and designates the relevant authorities through which the Social Housing and Mortgage Finance Support Fund will verify applicants’ compliance with the legal requirements. It further grants applicants the right to appeal in case their request is rejected, with all appeals to be reviewed and decided upon within one month of submission, ensuring fairness and the applicant’s right to reconsideration if found eligible.
